By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

To make purchases on the Website, you must be at least 18 years old.

By placing an order, you confirm that:

You may use the Website only for lawful purposes. You agree not to:

• Misuse or interfere with the Website,
• Compromise security features,
• Engage in fraudulent or illegal activity, or
• Copy, extract, or commercially use Website content without written permission from MODA54.

We reserve the right to suspend or terminate access at any time.

4. Product Information

We take reasonable care to ensure that product information is accurate. However:

• Colours may appear differently due to screen settings,
• Sizing and fit may vary by designer, and
• Product availability is subject to stock and designer production schedules.

We reserve the right to correct errors, update information, or withdraw products at any time without notice.

5. Order Acceptance

Your order constitutes an offer to purchase products from MODA54. We may decline or cancel orders if:

• The item is out of stock,
• Payment cannot be verified,
• Pricing or product information is inaccurate, or
• Fraudulent activity is suspected.

A binding contract is formed only when you receive a shipping confirmation email.

6. Pricing & Payment

Prices are displayed in GBP (£) and include VAT where applicable. International customers may view prices in USD/EUR for convenience. We accept major credit/debit cards and other payment methods offered at checkout. We reserve the right to adjust prices at any time.

7. Shipping & Delivery

Delivery estimates provided at checkout are approximations only. MODA54 is not responsible for delays caused by:

Couriers, Customs clearance, or Events outside our control. Once dispatched, your order will include a tracking link. Full details are provided in our Shipping Policy.

8. International Duties & Taxes

For customers outside the UK:

• Duties and taxes may be calculated at checkout (where supported),
• If not displayed, couriers may request payment before delivery, and
• Duties and taxes are non-refundable unless otherwise required by local law.

9. Returns & Refunds

You have 14 days from delivery to initiate a return through our Returns Portal. Returned items must be:

• Unworn, unused, and in original condition,
• Free of marks, scent, or damage,
• Returned with all packaging, and
• Returned with the MODA54 security tag intact.

Returns that do not meet these conditions may be rejected. Return postage is the responsibility of the customer.

Refunds are issued to the original payment method once items are inspected and approved. We do not currently offer exchanges. Full details are provided in our Returns & Refund Policy.

10. Faulty or Incorrect Items

If your order arrives damaged or incorrect, you must notify us within 48 hours by emailing clientcare@moda54.com with photographs and supporting details.

If approved, we will arrange a replacement or refund. This does not affect your statutory rights.

11. Gift Cards

MODA54 offers digital and physical gift cards. Gift cards are valid for 12 months, non-refundable, and cannot be exchanged for cash. Gift cards may be used to purchase any product available on the Website.

12. Special Orders & Pre-Orders

Certain pieces may be offered as made-to-order or pre-order. Estimated timelines will be stated on the product page. Custom or made-to-order items are non-returnable unless faulty.

13. Intellectual Property

All content on the Website — including text, imagery, logos, layout, and product descriptions — is the intellectual property of MODA54 or its designers.

You may not:

• Copy or reproduce Website content,
• Use images for commercial purposes, or
• Use MODA54 trademarks without written permission.

14. Privacy & Data Protection

MODA54 is committed to GDPR compliance. Personal data may be processed for:

• Fulfilling orders,
• Improving service,
• Fraud prevention, and
• Marketing (where consent is given).

15. Limitation of Liability

To the extent permitted by UK law, MODA54 is not liable for:

• Indirect or consequential losses,
• Courier or customs delays,
• Misuse of products, or
• Losses caused by colour or sizing variations.

Our total liability shall not exceed the value of the product purchased. Nothing in these Terms excludes liability where prohibited by law (e.g. negligence causing death or personal injury).

16. Force Majeure

MODA54 shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, transport disruption, or government restrictions.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of England.
